Can homosexual couples who are in Thailand get married and can one apply for a marriage visa on this basis?

No, legally, two people of the same gender cannot marry in Thailand. And also legal marriage between transsexuals cannot be done under Thai Law. Note that since you cannot get married you cannot apply for a marriage visa either. If you are over the age of 50 then you can apply for a retirement visa, but no marriage visa.

    in the USA it is legal to same sex if we marry here and they go back to thailand can I apply for a marriage visa here in the USA since the marriage is legal in the USA

      Dear Todd,
      Based on experience, the Thai immigration will not issue a marriage visa in Thailand. However, there were instances when a Thai Embassy in the USA issued a nonimmigrant O visa to the US citizens. I recommend for you to check with Thai Embassy in Washington DC, consulates in NYC, Los Angeles or Chicago if this is possible for you.
